In realization of the fact that Nepali people are the ultimate source of the ruling and the state power of the sovereign and independent Himalayan Kingdom, the newly formulated and adopted constitution will be the most appropriate and reliable governing system of the nation and, this sentiment has clearly been expressed by the entire Nepali citizens during the recent historical People's Revolution and considering the thoughts, feelings and people's verdict, it is believed that the election to the Constituent Assembly without any condition and, that the Constitution framed by the Constituent Assembly Members, will pave ways for the lasting economic, political and social justice to the Nepalese through which-basic Human Rights of every citizen is protected and preserved, to have special provision for the welfare of women and children and to establish brotherhood, unity and equality among all sections of the society, gender, religion and the ethnic communities and through adult franchise, to institutionally develop the democracy through the establishment of independent, efficient and transparent judicial system realizing the concept of the rule of the law thus bringing end to the 12 long years ongoing conflict in country through dialogue and without any further delay, to restore peace in the country; with the formation of Interim constitution, to go for Constituent Assembly election and since the announcement and implementation of the new constitution has been felt necessity incorporating the feelings, thoughts and the people's verdict during the historical People’s Movement-2006, the starting of the Interim Constitution, the ruling power and sovereignty will be brought into practice and the reinstated parliament through the People's Movement and, using the rights and responsibilities given by the mass to the parliamentarians - they will be responsible for the announcement of the new constitution for which the following key points and issues have been raised in the form of potential recommendations to incorporate in the upcoming Interim Constitution:
- Any child found within the country and whose parent's whereabouts is unknown, through the recommendations of the concerned authority, the child will have to be entitled to obtain citizenship certificate through any organization, institutions or individual the child is associated / attached to.
- There should be provision of celebration of anti trafficking day at national level to raise awareness among the general public against trafficking and commercial sexual exploitation of children and women.
- The sate should own responsibility in prioritizing and implementing of education and skill development programmes for the survivors and commercially sexually exploited and at-risk children and women.
- To amend the discriminatory act and laws and regulations those are against the welfare of women and children.
- Develop and implement income generation opportunities and skill development programmes for the successful and sustainable social reintegration of the survivors of commercial sexual exploitation.
- Generate better employment opportunities for those who are diligent, laborious and intelligent survivors and at-risk young people and women residing in shelter or rehabilitation centers.
- There should be provision of establishment of rehabilitation centers to provide holistic care, support services and free medical facilities to the survivors of trafficking and people living with HIV/AIDS and other infectious diseases.
- Develop policy and laws to take initiatives for the effective networking and monitoring with the neighboring countries for the prompt rescue operation of children and women who are in prostitution.
- Develop and empower youth and mobilize the youth force for the community awareness campaigns in the fight against commercial sexual exploitation and other forms of social evils.
- The state should develop strategies and be accountable to ensure that the survivors of commercial sexual exploitation and trafficking live dignified and respectful lives.
- Draft and enact a law that defines and prohibits the commercial sexual exploitation of children and women that provides for extraterritorial jurisdiction over all offenses that constitutes the commercial sexual exploitation of children and women.
- Draft and enact a law that defines and prohibits the prostitution of children and women by any person in accordance with the international law.
- Draft and enact a law that defines and prohibits trafficking of children and women for commercial sexual purposes and criminalize those who buy and sell children and young girls.
- Review and revise Nepal’s legislation prohibiting the practices of the Badi, Deuki and Jhuma and other communities to prevent girls from being commercially sexually exploited through these traditional practices.
- There should be provision of free, compulsory and quality education especially for the deprived children from remote areas who are vulnerable to commercial sexual exploitation.
- Ratify the international instruments related to child rights that Nepal has signed such as the Optional Protocol to the CRC on the sale of children, child prostitution and child pornography and the SAARC convention on preventing and combating trafficking in women and children.
- Draft and enact a law that defines and prohibits the production. Possession and distribution of child pornography, including images that are created and accessed over the internet in accordance with the international laws.
